版權法

看看這篇倉海兄介紹﹐談論到城中熱話‘私隱問題’的文章:不談假惺惺的道德,只講赤裸裸的法律。社會風氣如何﹐也不用多說。陳日君這老江湖也無話說﹐我這種閒人還評什麼?

我提議各大明星先把自己當成物品﹐用版權法註冊身體的每一部份﹐之後既然成為貨品﹐成了商標﹐就算赤裸裸的走到街上﹐別人影了也不能刊登。否則登了就可向雜誌收取辦權費﹐利益。如果雜誌登出了裸照﹐反而要撥捐比不登的更大利益﹐看來﹐就每個明星也可放心在家中自由活動﹐甚至以後也可向雜誌登出的每張不同角度的相片﹐要求不同的收費。當然﹐暫時是沒有這條法例。在知識產權法發展同時﹐可考慮這個方向﹐不過就對無錢買版權的小明星和平凡人保護不到了。就算像我這樣的垃圾文章﹐樓下也打句copyright ﹐其實是否可向未經我同意而link 我的人追究? 當然不成﹐雖然﹐版權法的CAP 528 COPYRIGHT ORDINANCE 的 section 4, 注明文學知識產權是受到保護﹐但$1,895註冊費窩﹐你比咩? 美國文學作品﹐就只需US$45。現在每樣事也說知識產權﹐其實到最終﹐還是利益歸何處。如果真的出書﹐這千零蚊也頗化算﹐因為同樣條例既 section 17.2, 就保到我死後五十年。

版權法是保護已"出版"的"作品",而且權利由作品原創者享有彧轉授.首先名人明星既不是"作品"也不能出版,故此不能授與版權.而且名人明星亦不是作品原創,因此不能授與版權.版權法是完全不適用.名人明星可以以其長相註冊為商標.但是商標是保護商響及產品,如果那一張註冊了的相不是用作商標,例如用作表示產品的來源,商標法是管不到的.商標法有所謂影射法(Passing Off),主要是針對冒牌的產品,對於貨真價實的相片是不保護的.

By the way, only US publications need to get registered for copyright. There is no this requirement in most countries of the world. Besides US Copytight can run longer than 50 years. Look at the copyright of mickey mouse, it has the extension of 75 years and it will live forever.

hehe, yeah, thanks, I have read that, and knew it doesn't cover living being, how about a tattoo of particular design on the body? yeah, as for the mickey design, they have to renew it afterwards. it's the literary work of an author that once registered, will cover it's copyright till 50 yrs after the author died

喂喂!各位律師大佬﹐我知無條甘既法律﹐不過是想將人當物件甘註冊一下。物件可受到保護﹐人卻受不到保護﹐不是很諷刺嗎? 法律﹐建立麻煩﹐人又喜歡尋找漏洞。而且﹐人壓根兒就本性喜歡逃法。這些社會問題是註定在不同的層面不斷重覆。

You are mixing up the US Copyright law and HK copyright law. There is no need for registration of copyright as far as I know. US copyright law, the Sonny
Bono Copyright Extension Act, which delayed the entrance of creative works into the public domain until up to 70 years after their creator's death.

Intellectual property law has an object to protect property abd human being. It is mainly commercial, even some cover moral right, it is never made to protect human right.

If you read law's article you can see he referred heavy to the Protect of Privacy report from HK Law Reform Commission. If you can so bored and drunk, you may spend some time to go over it. After that you may appreciate what is that whole protection of privacy and human right all about.

Striking the balance is the key concept of the privacy law.

But I digress. Thanks for letting me BS these things in you blog. I try to keep mine away from these things. I owe you a glass of wine.
